Part I — Terms and Conditions of Use
1. Object and User Definitions
PMR is a SaaS platform focused on Trade Marketing, Live Marketing, Merchandising and POS Audit management. The system enables data collection, field team tracking and information validation through Artificial Intelligence.
Client-User (Controller): Legal entities (Marketing Agencies, Brands, Trade Companies) that sign a contract with BEC System to use the platform.
Field-User (Data Subject / Field Team): Individuals (Promoters, Researchers, Auditors) registered and authorised by the Client to access the mobile app and execute data collection.
2. Employment Responsibilities and Relationship
The PMR platform acts exclusively as a technology provider. There is no employment, corporate or commercial representation relationship between BEC System and Field-Users.
The Client-User is the sole employer of its field team, fully assuming all labour, social security, tax and insurance obligations, releasing BEC System from any joint or subsidiary liability.
3. Features, Support and Business Model
Audit Technology: Anti-Fake GPS (5-metre accuracy), AI for POS photo validation and offline synchronisation.
Technical Support: BEC System support is restricted to managers designated by the Client. It is the Client's responsibility to provide first-level support to its field team.
Billing Model: The platform operates on a Pay-per-Visit model. Non-payment may result in access suspension, without generating any right to compensation.
White-Label Licence: When contracted, constitutes a temporary licence of use only, with no transfer of copyright or source code.
Part II — Privacy Policy and Data Protection
4. Data Protection Roles (GDPR / LGPD)
Controller: The Client-User defines the purpose of data collection, registers promoters and manages the information base.
Processor: BEC System (PMR) acts strictly as a Data Processor, providing the technological infrastructure to process and store data under the Controller's guidelines.
5. Data Collected and App Permissions
Registration Data: Name, email, phone, ID number (entered by the manager/Client).
Location (GPS): Precise geolocation to validate Check-in/Check-out and Anti-Fake GPS rules.
Camera and Images: Camera access to capture photos of shelves, products, receipts and audit selfies, validated via AI.
Device Information: Model, operating system, IP and error logs, used for technical support and fraud prevention.
6. Purpose, Ownership and Data Confidentiality
Exclusive Ownership: All data collected belongs exclusively and entirely to the Client-User (Controller).
Prohibition of Secondary Use: BEC System does NOT share, sell or use collected data for any purpose beyond the contracted operation.
The legal basis for processing is the performance of a contract and the legitimate interest of the Client (Art. 6 GDPR).
7. Storage, Security and Retention
Data stored in AWS cloud with encryption in transit and at rest. BEC System will store data only for the duration of the contract. After termination or Controller request, data will be deleted, except where retention is required by law.
8. Data Subject Rights (Field Team)
As the Client is the Controller, Field-Users wishing to exercise their GDPR rights (access, rectification, erasure, portability) should direct their request to the HR department or management of their contracting Agency/Company.
BEC System provides the Client with the necessary tools to fulfil staff requests within the PMR dashboard.
Part III — Final Provisions
9. Intellectual Property of the Platform
All technology, source code, AI, layout, trademark and databases of the PMR system are the exclusive intellectual property of BEC System. Reverse engineering, copying or unauthorised distribution is strictly prohibited.
10. Amendments and Jurisdiction
BEC System reserves the right to update this document at any time, notifying Clients of material changes. The courts of São Paulo, Brazil shall have jurisdiction over any disputes.
